Terms
All products listed herein are F.O.B. Medina, Minnesota 55340 U.S.A. Terms are such as the company may extend to the purchaser. U.P.S. is the standard mode of shipping. Shipping and handling charges are not included in the net prices. Insurance will be added to all orders shipped via U.P.S. All prices are subject to change at any time and without notice. Sales, Use Taxes, and any Customs Fees, when applicable, are the purchaser's responsibility.
Conditions
Intercomp shall not be liable for loss, damage, detention, or delay resulting from causes beyond its reasonable control or caused by fire, strike, civil or military authority. Priority request of the US Government, or any department branch or representative thereof, insurrection or not, embargoes, car-shortages, wrecks, or delays in transportation, or inability to obtain necessary labor, material, or manufacturing facilities due to such causes, nor in any event from consequential damage.
All claims for shortages not due to an act or omission of the carrier must be filed with Intercomp within ten days after receipt of shipment.
Receipt of goods by the purchaser upon delivery by a transportation agency shall contribute a waiver of all claims.
Additional Terms
This writing constitutes the entire agreement of the parties and is effective immediately. There are no representations or warranties other than those contained herein. All titles to clauses contained in this agreement are for identification only and shall not be construed as being a substanive part of this agreement. This agreement is governed by the laws of the State of Minnesota. Any legal actions regarding this agreement shall be brought exclusively in the courts of the State of Minnesota. No legal action of any form arising out of this agreement may be brought more than one year after the date of the order, or in case of non-payment, after one year from the date of last payment.
Export Terms and Conditions
Orders will be shipped whenever possible by a specified freight forwarder. When one is not specified, we will submit a request for customer approval of proposed method prior to completed purchase. The cost of additional export, documentation, insurance, freight, etc. will be included in this quotation and is the responsibility of the purchaser. The purchaser is responsible for completing and customs procedures and is responsible for all additional customs fees.
Warranty
Subject to the terms and conditions as stated herein, Intercomp Company, Inc. (herein referred to as "Intercomp") warrants its equipment to be free from defects in material and factory workmanship for a period of twelve months (batteries, hydraulics, and cables for a period of three months) from the date of shipment from Medina, MN. 55340 U.S.A.
Terms and Conditions of Limited Warranty
This obligation is limited exclusively to defective original equipment manufactured or supplied by Intercomp and is subject to the inspection and analysis by Intercomp as to conclusively identify or confirm the nature and cause of failure.
Intercomp responsibility is confined to repair, replacement or credit, and does not extend coverage to labor, material or service charges involved in removal or installation of equipment.
Defective components, mechanical or electrical, will be repaired or replaced at Medina, Minnesota, provided the user ships the equipment freight prepaid to Medina, Minnesota, in accordance with the Intercomp (RMA) return to manufacturer authorization procedure.
Intercomp is not responsible and will not be held liable for losses, injury or damage caused to persons or property by reason of the installation of Intercomp products or their mechanical failure.
This warranty is not applicable for expenses either direct or consequential that may arise for the use of or inability to use these products.
Intercomp reserves the right to incorporate improvements in material and design of the products without notice and is not obligated to incorporate the same improvements in equipment previously manufactured.
Intercomp shall not be obligated under any warranty different from it's warranty set fourth herein. The Intercomp warranty is limited to the initial customer and installation and is not intended to insure to the benefit of a secondary owner in the event of resale.
Statement of Limited Warranty
This warranty shall not apply to equipment which:
- Has had repairs or modifications not authorized by Intercomp which in Intercomp judgement has affected the performance or reliability.
- Has been subject to misuse, negligent handling, improper installation, accident, damages by fire, water or act of God.
- Has had serial numbers altered, defaced or removed.
- Has not followed Intercomp's reccomendations for galvanizing or stainless steel construction for installations in harsh environments.
Freight Carrier Damage
Claims for equipment damaged in transit must be referred to the freight carrier. Visible damage should be reported immediately. Concealed damage as soon as possible or in any case, within ten days of receipt of shipment, in accordance with freight carrier regulations.
"THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES OF QUALITY WHETHER EXPRESSED OR IMPLIED"
(Including any warranty of merchantability or fitness for purpose). The remedy(ies) provided above shall be the Buyer's sole remedy(ies) for any failure of Intercomp to comply with the warranty provisions, whether claims by Buyer are based in contrast or in the tort (including negligence) or otherwise.
Return of Standard Equipment
At Intercomp, we want you to be completely satisifed with any product purchased from us. If a new product does not operate properly or is defective, obtain an RMA number from Intercomp Customer Service and return it within 30 days of delivery from Intercomp, freight prepaid.
Intercomp, at our option, may assess a restocking charge if the equipment was:
- Not correctly specified for the application intended.
- Damaged beyond reasonable recovery.
The restocking charge is directly proportional to the amount of time and material expense required by Intercomp to return the item to a saleable condition. If an item was held in excess of 30 days, a minimum restocking charge of 15% may be assessed.
Special Order, Modified, Unusual or Non-Stock Items
We will repair or replace, at our option, equipment which is defective by nature or poor quality materials or substandard workmanship, within the specified warranty period. No returns will be accepted for any special order equipment, or for equipment physically modified or altered in the field. There will be a minimum cancellation fee of 15% for any partial or complete order that is not delivered in its entirety.
Return Procedure
When returning equipment for repairs or warranty reimbursement, follow these simple steps when calling to return equipment for repair:
- Call Intercomp at 800-328-3336 or 763-476-2531 and ask for the Customer Service Department. Ask for a Return to Manufacturer Authorization (RMA) number.
- Include with your shipment:
- Copy of the original receipt or invoice.
- The RMA number, your name, shipping address, daytime telephone number and a detailed description of the problem you are experiencing.
- Clearly mark the RMA number on the outside of the package. This will help us speed your package through our receiving process.
